Key Developments in the Fight Against Mass Firings

We want to update you on key developments in legal actions challenging the Administration’s mass firings.
 
NTEU’s Mass Firing Suit. In February, after President Trump ordered his agencies to start large-scale reductions-in-force and to fire large numbers of probationary and trial employees, we immediately sued to stop these firings. That lawsuit is ongoing. On May 27, we asked the Court for permission to update our complaint. When we filed the lawsuit in February, we named several of our represented agencies as defendants, where information suggested that those agencies would be targeted at that time. In our updated complaint, we added allegations to cover employees in more of our agencies, such as Interior (BLM and NPS), CFTC, FHFA, FTC, and FDIC. We also updated the Court on the details of the ongoing, unfair firings across multiple agencies. We will update you as the case proceeds.
 
California RIF Case. A federal judge in California issued an order on May 22 stopping the RIFs at several NTEU-represented agencies, including Treasury, HHS, DHS, Energy, Interior, Agriculture, EPA and DOJ. The Court said that, “Agencies may not conduct large-scale reorganizations and reductions in force in blatant disregard of Congress’s mandates[.]” As expected, the government immediately appealed this order and asked the higher Court to stay—or pause—the lower court’s helpful order.
 
MSPB Probationary Firing Case. An administrative judge at the Merit Systems Protection Board (MSPB) is allowing a group of probationary employees to proceed as a group with their legal challenge. This is the first approved class action of this kind and will make it a lot easier for these employees to appeal. The decision allows most DHS probationary or trial employees (with some limited exceptions) who were issued termination notices February 14-20, 2025, to move forward with their arguments that they were wrongly fired. We anticipate additional forthcoming decisions regarding class action filings at other NTEU-represented agencies. Once those are issued, we will share that information with you.
